Cross Border Taxation

Our Cross Border Taxation Group, lead by Brent Axworthy, specializes in services to clients who have unique tax and related issues that arise as a result of cross border commerce, including Canadians operating businesses and investing abroad, and non-residents and foreign nationals investing, carrying on business, or residing in Canada.

It is increasingly common for corporations and individuals to operate outside of the borders of their home countries. We assist those persons address such matters as exposure to Canadian and foreign tax regimes, optimal structuring of outbound and inbound investment, utilizing the relieving provisions of international tax treaties, and minimizing overall tax liability.

Traditionally, Canadian cross border taxation matters have predominately involved the United States, an area in which Berris Mangan has developed extensive expertise. Recently we have been seeing increasing cross border business with more distant countries, particularly in Asia. We are working together with tax experts in those countries in order to design investment structures that effectively address Canadian and foreign tax considerations.
